Acceptable Use Policy
Effective
This Acceptable Use Policy applies to everyone who uses Diced, a service of J&T Solutions Inc., a Delaware corporation doing business as Diced, 251 Little Falls Drive, Wilmington, DE 19808, United States. It is part of the Terms of Service.
You accept this policy before your first reveal and before you create an API key. It applies to the app, the API, the MCP server, webhooks, and every lead you get from Diced, including leads you exported and leads an AI agent fetched for you.
Report a suspected violation to legal@diced.si. Questions about whether a use is allowed go to support@diced.si. Ask before you act if you are not sure.
1. The basic rule
Use Diced only for lawful business marketing, sales and prospecting. You are responsible for your outreach and for following every law that applies to it.
2. No FCRA purposes
Diced is not a consumer reporting agency. Diced data is not a consumer report and has not been gathered or checked to the standards of the Fair Credit Reporting Act.
You may not use Diced data, in whole or in part, as a factor in deciding whether a person is eligible for anything the Fair Credit Reporting Act covers, or for any other permissible purpose under 15 U.S.C. § 1681b. That includes:
- credit, loans or other financing, including pre-qualification or account review;
- employment, including hiring, promotion, retention, reassignment and background checks;
- insurance underwriting, rating or eligibility;
- housing, including tenant screening and rental decisions;
- licenses, government benefits or other eligibility decisions;
- check cashing, account opening or identity verification used to grant or deny a service;
- any other use as a consumer report.
The same ban covers similar state laws, such as state consumer reporting and investigative consumer reporting laws.
3. Calls and texts: follow the TCPA and do-not-call rules
You may not use Diced data to make calls or send texts that break the Telephone Consumer Protection Act, the Telemarketing Sales Rule, FCC rules, or state telemarketing and do-not-call laws. In particular, you may not:
- make calls or send texts using an automatic telephone dialing system, or an artificial or prerecorded voice, including AI-generated voices, without the prior express consent the law requires, which for marketing usually means prior express written consent;
- call or text numbers on the National Do Not Call Registry for telemarketing unless an exemption applies, such as an established business relationship or the person's written permission;
- call or text numbers on a state do-not-call list without meeting that state's rules;
- call or text anyone who has asked you not to contact them, or ignore your own internal do-not-call list;
- call or text outside the hours the law allows in the recipient's time zone;
- hide or fake caller ID, or skip the identification and disclosures the law requires;
- text without honoring STOP and other opt-out replies.
Diced does not give you consent to call or text anyone. Our data does not show whether a number is on a do-not-call list, is a wireless number, or was reassigned. You must check those yourself, for example with the National Do Not Call Registry and the FCC's Reassigned Numbers Database. [CONFIRM: whether to say anything about wireless or reassigned number checks, given the data has mobile_phone fields.]
4. Email: follow CAN-SPAM
You may not use Diced data to send email that breaks the CAN-SPAM Act or similar state laws. Every commercial email you send must:
- have accurate header and "From" information;
- have a subject line that is not misleading;
- identify itself as an ad where the law requires;
- include a valid physical postal address;
- include a clear, working way to opt out;
- stop further commercial email to anyone who opts out, within 10 business days.
You may not harvest addresses, use dictionary attacks, relay through computers without permission, or send through deceptive means. Follow the rules of your email provider, too.
5. Honor opt-outs
You must honor every opt-out, unsubscribe, do-not-call and deletion request you receive, promptly and as the law requires. If Diced tells you that a person has opted out or asked for deletion, follow section 9.3 of the Terms.
Keep your own suppression lists. Do not re-upload, re-reveal or re-contact people who opted out.
6. No harm to people
You may not use Diced to:
- harass, threaten, intimidate, stalk, dox or abuse anyone;
- find, locate or track a specific person to confront them or for any personal reason, such as finding an ex-partner or a person who has cut off contact;
- commit or help with fraud, scams, phishing, identity theft or impersonation;
- collect debts, skip trace or repossess property [CONFIRM: whether to ban debt collection and skip tracing outright or allow them with FDCPA compliance];
- support law enforcement, immigration enforcement, surveillance or intelligence work without our written agreement and a valid legal process;
- target or exploit people who are vulnerable because of age, illness, financial hardship or grief, for example with predatory loans or scams;
- send content that is unlawful, defamatory, obscene, or that promotes violence or hate.
7. No discrimination
You may not use Diced data to discriminate against people unlawfully, or to exclude or target people based on a protected characteristic. That includes race, color, ethnicity, national origin, religion, sex, gender identity, sexual orientation, age, disability, marital or familial status, veteran status, and genetic information.
This applies with special force to offers of housing, credit, insurance, employment and public accommodations. You may not use demographic fields such as age range, gender, marital status, children, income or net worth to steer or exclude people from those offers in violation of fair housing, fair lending, equal employment or civil rights laws.
8. No sensitive-category targeting
You may not use Diced to target, segment, infer or reach people based on sensitive characteristics. These include:
- health conditions, treatments, medications, pregnancy or reproductive health, mental health, and disability;
- sexual orientation, sex life and gender identity;
- racial or ethnic origin, religious or philosophical beliefs, and union membership;
- immigration or citizenship status;
- criminal history or arrests;
- precise geolocation, or visits to sensitive places such as clinics, places of worship or shelters;
- financial distress, such as debt, bankruptcy or poor credit;
- data about children under 16.
Some intent topics relate to health, money or other personal subjects. You may not use those topics to make claims or assumptions about a specific person, such as "we know you have diabetes", or to target people in ways that break laws on consumer health data or sensitive data. [CONFIRM: review the intent topic list for health, financial distress and other sensitive topics, and decide whether to block or filter them before launch. Washington's My Health My Data Act, Nevada SB 370 and state laws on sensitive data may apply to health-related intent signals.]
9. No reselling raw data
You may not sell, rent, license, share, publish or give away Diced data as raw data, as a list, or as part of a data product that competes with Diced. You may not use Diced data to build, add to or train a database, data product or model that you offer to others.
You may use Diced data inside your own marketing and sales, and agencies may run campaigns for their clients, as long as the client does not get the raw data to use as its own. [CONFIRM: agency use. Decide whether agencies may hand lead lists to clients, and on what terms.]
10. No scraping or abuse of the Services
You may not:
- scrape, crawl or harvest the website, app or docs;
- use automation other than the documented API and MCP server;
- run queries designed to copy, map or rebuild our dataset, such as enumerating filters, topics or masked previews;
- try to unmask previews or collect hidden fields any other way;
- get around rate limits, chip caps, captchas, authentication or the signup bonus rules, including through multiple or fake accounts or disposable email addresses;
- share API keys outside your organization, or resell API access;
- probe or attack the Services, or load them in a way that degrades them for others.
The End User License Agreement has the full list of software restrictions.
11. Where you may use Diced
Diced data is about people and businesses in the United States, and Diced is built for marketing in the United States. You may not use Diced, or contact people with Diced data, from or in any country where that use is unlawful. You may not use Diced from a country subject to comprehensive U.S. sanctions or in breach of U.S. export rules.
Do not upload data about people in the European Economic Area, the United Kingdom or Switzerland for enrichment. [CONFIRM: whether to restrict signups to U.S. businesses only.]
12. Lawful data and notices
Only upload data you have the right to use. Give every privacy notice, and get every consent, the law requires for your use of personal information. That includes any notice you must give under state privacy laws when you receive personal information from a data broker.
13. AI agents
If you connect an AI agent through the MCP server or the API, this policy applies to everything the agent does. You are responsible for the agent's outreach and for the chips it spends. Do not let an agent contact people on its own without the safeguards this policy requires.
14. Enforcement
If we believe you have broken this policy, we may, with or without notice:
- warn you;
- remove content or data, or block features;
- suspend or revoke API keys and MCP connections;
- suspend or close your workspace and account;
- withhold or remove chips, without refund;
- report the activity to the authorities or to people harmed by it.
We may investigate suspected violations and keep records needed for that. Breaking this policy is a material breach of the Terms, and the indemnity in section 21 of the Terms applies.
15. Changes
We may update this policy. We will post the new version with a new date and tell workspace owners about material changes.
